BYRON BAY SURF FESTIVAL 2017 SURF ART MARKET VENDOR TERMS AND CONDITIONS

  • STALL BOOKINGS CAN BE MADE AS EARLY AS AUGUST 2016 AND INCUR A NON- REFUNDABLE DEPOSIT OF $100. THE TOTAL FEE FOR A STANDARD STALL SPACE (3X3M) IS $270 +GST (INC. AMENITIES) PAYABLE IN FULL BY DECEMBER 19TH 2016. DELAYS OF OUTSTANDING PAYMENTS WILL RESULT IN THE LOSS OF BOOKINGS. CANCELLATIONS OF BOOKINGS MUST BE MADE BY DECEMBER 19TH 2016 IN ORDER TO RECEIVE THE FEE BACK (EXCLUDES DEPOSIT AMOUNT). PAYMENTS CAN BE MADE VIA DIRECT DEBIT INTO BYRON BAY SURF FESTIVAL’S BANK ACCOUNT. PAYMENT DETAILS ARE OUTLINED ON TAX INVOICE ISSUED.
  • VENDORS ARE REQUIRED TO BUMP IN AT LEAST TWO HOURS BEFORE THE COMMENCEMENT OF THE SURF ART MARKETS (7-9AM). BUMP OUT CAN BEGIN AFTER THE CLOSE OF THE MARKETS (FROM 4.30PM). VENDORS MUST PROVIDE THEIR OWN MARQUEE OR SIMILAR STRUCTURE FOR THEIR STALL SPACE ALLOCATED. THE STALL MUST BE PEGGED DOWN AND MANNED AT ALL TIMES.
  • THE STALLHOLDER MUST NOT CAUSE DAMAGE, MAKE ALTERATIONS OR ADDITIONS OF ANY NATURE TO, OR CARRY OUT ANY DAMAGING WORKS OF ANY NATURE TO THE STALL AREA OR APEX/DENNING PARKS LAND AND THAT, IF ANY DAMAGE IS CAUSED, THE COSTS OF ANY REPAIRS, MAKING GOOD OR REPLACEMENT ARE BORNE BY THE STALLHOLDER.
  • PLEASE NOTE THAT ACCESS TO POWER IS EXTREMELY LIMITED, AND YOU CANNOT BE GUARANTEED ACCESS TO POWER OUTLETS WITH ANY OF THE MARKET STALLS. IF YOU MUST USE POWER IN ORDER FOR YOUR PRODUCT(S)/SERVICE(S) TO BE SOLD OR PROMOTED PLEASE CONTACT US IMMEDIATELY.
  • A COPY OF YOUR CURRENT PUBLIC LIABILITY INSURANCE POLICY (MIN $10M) – AND OTHER RELEVANT PERMITS AND LICENCES - MUST BE RECEIVED VIA EMAIL BEFORE THE DECEMBER 19 TH 2016.
  • IN THE CASE OF ‘ADVERSE WEATHER’ EVENTS (ELECTRICAL STORM, HIGH WINDS, HIGH RAINFALL/FLOODING ETC.), THE BBSF HAS CANCELLATION INSURANCE IN PLACE FOR SUCH EVENTS. IN THE UNLIKELY CASE THAT 'ADVERSE WEATHER' DEEMS THE SURF ART MARKETS UNABLE TO OPERATE FOR IT'S TOTALITY (9AM-4.30PM), YOUR STALL FEE WILL BE REFUNDED (EXCLUDING THE DEPOSIT AMOUNT). WE DO NOT, HOWEVER, COVER ANY LOSS OF INCOME THAT WOULD HAVE OCCURRED IF THE MARKETS WENT AHEAD (CONSEQUENTIAL LOSS) OR IF YOUR STALL IS SET UP FOR A FEW HOURS ONLY. IT IS UP TO THE BUSINESS OWNER TO HAVE THIS INSURANCE IN PLACE FOR YOUR BUSINESS.
  • THE BYRON BAY SURF FESTIVAL IS COMMITTED TO REDUCING ITS ENVIRONMENTAL IMPACT. ACCORDINGLY, OUR PRODUCTION AND MANAGEMENT TEAMS ARE DEDICATED TOWARD PRODUCING AN EVENT THAT IS ENVIRONMENTALLY RESPONSIBLE, SUSTAINABLE AND ACCOUNTABLE. WE PROMOTE AND INITIATE SUSTAINABLE PRINCIPALS IN ALL ASPECTS OF THE EVENT, INCLUDING ZERO-WASTE STRATEGIES THAT REDUCE LANDFILL (PRIMARILY THE ELIMINATION OF SINGLE-USE PLASTICS) AND OFFER RECYCLING AND COMPOSTING WASTE STREAMS THROUGHOUT THE FESTIVAL. THEREFORE, THIS IS A SINGLE-USE PLASTIC FREE EVENT (PROHIBITED USE OF PLASTIC SHOPPING BAGS, CUTLERY, STRAWS, BOTTLES, CONTAINERS, CUPS AND PLASTIC PROMO MATERIAL). WE ENCOURAGE THE USE OF SUSTAINABLE, COMPOSTABLE, RECYCLABLE OR RE -USABLE PACKAGING TO BE SUPPLIED WHEREVER APPLICABLE.
  • I UNDERSTAND THAT IF I, OR MY STAFF, DO NOT COMPLY WITH THE BBSF RULES AND REGULATIONS HEREIN, I MAY BE ASKED TO LEAVE THE EVENT SITE OR BE LIABLE FOR ANY RESULTING DAMAGE TO EQUIPMENT OR PEOPLE. I AGREE TO COMPLY WITH BBSF SURF ART MARKET MANAGEMENT DIRECTIVES. I, AS THE OWNER/OPERATOR OF THE STALL, HEREBY INDEMNIFY THE EVENT FOR ANY LOSS, DAMAGE, LIABILITY OR ANY OTHER ACTION IN ANY WAY RESULTING FROM MY STALL APPLICATION OR USE OF MY STALL SITE AREA.
  • IN THE APPLICATION PROCESS, I CERTIFY THAT I HAVE READ, UNDERSTAND AND AGREED TO ABIDE BY ALL OF THE BBSF SURF ART MARKET RULES AND REGULATIONS AS PROVIDED HEREIN.
